Background

On May 12, 2023, ZH, a previous Google engineer under an H1B visa, reached out to GoElite for urgent assistance. He was laid off with H1B visa set to expire on May 31, and wanted to change his status from H1B to F1 to secure and extend his legal status. However, although he had earned two STEM graduate degrees in engineering, he chose to apply for an associate degree in Accounting Technology/Technician and Bookkeeping from a community college, and waited weeks for the admission letter .

Challenge

ZH faced an urgent and complex situation as his H1B visa was expiring in less than 20 days following his layoff. Within this tight timeframe, he needed to complete a school application, secure an admission letter and I-20, and submit the change of status I-539 application to avoid losing his legal status and being forced to leave the country.

Additionally, ZH lacked knowledge about the H1B to F1 transition process. With two graduate degrees in STEM fields already, his decision to pursue an associate degree in Accounting Technology/Technician and Bookkeeping from a community college risked raising questions from USCIS about his intent, as this degree did not enhance his previous qualifications.

Furthermore, the community college option posed a challenge for ZH's future work prospects in the U.S., as it did not offer continued work authorization, and the longer wait time for admission and I-20 increased the risk of not meeting the deadline for his change of status application, potentially resulting in him falling out of status.
